Phoebe Putney Hospital has a long history, with Judge Francis Flagg Putney making a founding donation of $25,000 in 1911. The hospital was named for his mother, Phoebe, and from the start, it aimed to serve all races, which was rare for the South at that time. Initially offering twenty-five beds and one operating room, Phoebe Putney grew over decades with expansions adding hundreds of beds. The hospital authority oversaw these changes, and in 1990, it restructured for flexibility, allowing for growth outside the county.

Building the Phoebe Putney Health System

Phoebe Putney Health System (PPHS) emerged and began to build or buy facilities, expanding services into surrounding areas. The system managed significant assets and employed thousands of people, becoming the region’s largest employer. It included multiple hospital campuses and a large physician group, with many clinics serving the population. The PPHS focused on expansion, aiming to be the region’s most comprehensive provider.

Phoebe Putney Hospital’s Monopoly Play

Phoebe Putney Hospital was one of two hospitals in Dougherty County, Georgia, facing a rival, Palmyra Medical Center. Together, they controlled 86 percent of the market. PPHS devised a plan in 2010 to buy Palmyra. The Hospital Authority of Albany-Dougherty County was key; PPHS used its funds, and the Authority purchased Palmyra, then leased it back to PPHS for $1 per year. This maneuver effectively granted Phoebe Putney Hospital a monopoly. The FTC challenged this action, alleging antitrust violations and arguing it would lessen competition. The FTC filed a complaint in 2011, following the $195 million acquisition from HCA, a large hospital operator.

Legal Battles and FTC Scrutiny of Phoebe Putney

Phoebe Putney argued for state-action immunity, claiming its actions followed Georgia’s Hospital Authorities Law, which allowed entities to provide healthcare and acquire hospitals. The Authority contended this power could be used anticompetitively. Federal courts initially sided with Phoebe, dismissing the FTC’s case. However, the Supreme Court disagreed, ruling Georgia’s policy was not clear and the state did not intend monopolies, emphasizing that competition is a national policy. The FTC’s challenge continued, eventually leading to a settlement in this significant healthcare news story.

Settlement and Consequences for Phoebe Putney

The FTC settled with Phoebe Putney in 2015 under specific conditions. Phoebe Putney could not acquire more facilities in the Albany area for 10 years and could not oppose new hospital applications for five years. The acquisition led to new debt for Phoebe, with expenses rising significantly. Reports cited nearly $200 million spent on buying and closing most of Palmyra. Many Albany residents struggled with medical bills, and the hospital’s reputation suffered, with concerns about patient care, including high readmission rates and bedsores, noted in reports.
