Washington, D.C. – The Trump administration has enacted an indefinite pause on processing immigration applications filed by specific groups of migrants from Latin America and Ukraine who were allowed entry into the United States under certain programs established during the Biden administration. This action targets individuals who entered the country through policies utilizing the presidential parole authority, including the notable Uniting for Ukraine program.

Understanding the Policy Shift

The directive places an administrative hold on all “pending benefit requests” from migrants already residing in the U.S. but who arrived via these specific parole pathways. This encompasses a range of applications that could include, but are not limited to, requests for work authorization, status adjustments, or other forms of immigration relief.

Citing heightened concerns over potential fraud and national security risks, the administration stated the pause will remain in effect while officials undertake a comprehensive review process. The stated objective is to identify potential fraud cases and to enhance vetting procedures designed to mitigate national security and public safety concerns.

The order originated from Andrew Davidson, a top official within U.S. Citizenship and Immigration Services (USCIS), the federal agency responsible for processing immigration benefits. According to an internal memo dated February 14, which was obtained by CBS News, the directive was issued by Davidson to halt the processing of these specific applications. This information was corroborated by two U.S. officials familiar with the matter.

Davidson’s memo specifically indicated that some migrants admitted under certain programs, including one known as CHNV (Cuba, Haiti, Nicaragua, Venezuela), “were not fully vetted” prior to their entry. This perceived gap in initial screening appears to be a primary driver behind the current processing suspension.

Focus on Parole Authority

The Trump administration’s action directly targets the use of humanitarian parole, a long-standing executive authority that allows individuals to enter or remain in the U.S. temporarily for urgent humanitarian reasons or significant public benefit. The Biden administration utilized this authority on what the current administration describes as an “unprecedented scale” to manage increased migration flows and provide refuge for displaced populations.

The Trump administration argues that this expansive use of parole authority under Biden constituted an abuse of the statute, intended for limited, case-by-case use, rather than as a broad policy tool. The current pause is seen by supporters as a necessary step to reassess and potentially roll back the scale and scope of these programs.

Conditions for Lifting the Pause

The internal memo from Andrew Davidson suggested that the processing pause is not necessarily permanent but could be lifted. The condition for resuming processing is the completion of a “comprehensive review and evaluation” of the relevant programs and vetting procedures. This review is expected to lead to the implementation of more stringent screening protocols.

Official Confirmation

The Department of Homeland Security (DHS), the parent agency of USCIS, confirmed the existence of the “administrative hold.” A spokesperson stated that the hold was enacted pending the completion of additional vetting procedures specifically aimed at addressing potential issues related to fraud, public safety, or national security. The confirmation aligns with the reasons cited in the internal USCIS directive.

Immigration advocates and legal experts have expressed concerns about the impact of this pause on individuals who have already been vetted and admitted into the country and who are now seeking to regularize their status or gain work authorization. The indefinite nature of the suspension leaves these individuals in a state of uncertainty regarding their future in the United States.

The decision marks a significant shift in policy implementation regarding migrants who entered under the previous administration’s specific humanitarian initiatives, signaling a move towards stricter controls and increased scrutiny under the new administration.
