Washington D.C. – U.S. Attorney General Pamela Bondi announced federal criminal charges on June 6, 2025, against Kilmar Abrego Garcia, a national of El Salvador. The charges, which include Alien Smuggling and Conspiracy to Commit Alien Smuggling under Title 8, U.S. Code 1324, were detailed in a 10-page sealed indictment returned by a grand jury in the Middle District of Tennessee on May 21, 2025.

The indictment was unsealed on June 6, 2025, coinciding with the Attorney General’s announcement and Mr. Abrego Garcia’s arrival back in the United States to face prosecution. This development follows a period of legal uncertainty after Mr. Abrego Garcia was mistakenly deported to El Salvador in March 2025 by the Trump administration, despite reportedly holding legal status in the United States at the time.

Allegations of Extensive Smuggling Operation

The charges against Mr. Abrego Garcia relate to his alleged participation in a significant human smuggling operation. According to the indictment, this operation was active for approximately nine years, between 2016 and 2025. Prosecutors allege that the network was involved in transporting migrants from various Latin American countries into the United States.

The investigation leading to these federal charges stems, in part, from a traffic stop conducted in Tennessee in November 2022. Details of the traffic stop and its specific connection to Mr. Abrego Garcia were not immediately made public, but the indictment indicates its role in uncovering aspects of the alleged smuggling activities.

Mistaken Deportation and Legal Challenge

The case of Kilmar Abrego Garcia gained attention earlier this year when he was deported in March 2025. His deportation was reportedly carried out by the Trump administration at a time when he held legal status, raising questions about immigration procedures. This led to a lawsuit filed by his wife in Maryland, challenging the legality of his removal and advocating for his return to the U.S.

The Charges: Alien Smuggling and Conspiracy

The two core charges against Mr. Abrego Garcia are Alien Smuggling and Conspiracy to Commit Alien Smuggling. Title 8, Section 1324 of the U.S. Code pertains to bringing in and harboring aliens. Specifically, subsection (a)(1)(A) of this statute prohibits bringing or attempting to bring an alien to the United States at a place other than a designated port of entry or any place other than as authorized by the Attorney General.

The conspiracy charge indicates that prosecutors believe Mr. Abrego Garcia acted in concert with others to plan and execute these alleged smuggling operations. Conspiracy charges often broaden the scope of culpability, allowing the government to prosecute individuals who were involved in the planning or facilitation of a crime, not just those who carried out the act directly.
