Trump Administration Mandates Stricter Healthcare Price Disclosure in Push for Transparency

Washington D.C. – President Donald Trump has issued a new executive order directing key federal agencies to reinforce existing regulations aimed at enhancing healthcare price transparency across the United United States. The order mandates that the Departments of Treasury, Labor, and Health and Human Services (HHS) strengthen enforcement of rules initially established by a previous executive order signed in 2019 during President Trump’s first term.

The move signals a continued focus by the administration on tackling what it describes as “hidden” healthcare prices and “opaque” pricing arrangements within the nation’s complex health system. According to a statement from the White House, these practices are seen as major contributors to a lack of accountability within the healthcare industry and place an undue burden of costs directly onto patients.

Bolstering Existing Transparency Mandates

The executive order specifically targets compliance and enforcement of the prior 2019 regulations. Those earlier rules established specific requirements for both healthcare providers, such as hospitals, and health insurers.

Hospitals were mandated under the 2019 order to make public pricing information for a list of up to 300 “shoppable” services – common procedures or treatments that patients can realistically compare prices for before receiving care. In addition to this public display, hospitals were also required to provide a comprehensive, machine-readable file detailing all their standard charges, including negotiated rates with various insurers. The intent behind this requirement was to enable sophisticated data analysis and comparison of prices across different hospital systems.

Health plans, under the same 2019 directive, were tasked with similar disclosure requirements. They were compelled to post negotiated rates for in-network services, historical data on payments to out-of-network providers, and pricing information for prescription drugs. Furthermore, health insurers were required to develop and offer a consumer-facing online tool to allow their members to easily search and compare costs for healthcare services and items.

Key Updates in the New Order

The recent executive order builds upon these foundations by providing updated directives to the federal agencies responsible for overseeing and enforcing the regulations.

A significant focus of the new order is on ensuring that the information disclosed reflects the actual prices patients can expect to pay, rather than merely estimates. This distinction is crucial for patients making informed decisions about their care and potential out-of-pocket expenses.

The order also emphasizes the need for prices, including those for prescription drugs, to be comparable across different hospitals and insurers. This comparability is intended to facilitate meaningful price shopping and foster greater competition based on cost, in addition to quality.

Furthermore, the executive order specifically requires agencies to update federal enforcement policies related to these transparency requirements. The stated goal of this update is to improve overall compliance with the existing and reinforced price disclosure rules. The administration believes that more robust enforcement is necessary to ensure that hospitals and insurers are fully adhering to the mandates.

Administration’s Stated Goals

The White House reiterated the administration’s commitment to the principle of healthcare price transparency. Their official statement accompanying the order declared, “The Federal Government will continue to promote universal access to clear and accurate healthcare prices and will take all necessary steps to improve existing price transparency requirements.”

This latest order underscores the administration’s strategy of using executive action to pressure the healthcare industry into revealing pricing information that has historically been considered proprietary or difficult for consumers to access. The administration argues that making prices transparent is a vital step towards empowering patients and potentially lowering healthcare costs through increased competition and informed consumer choices.

Industry reactions to price transparency mandates have been mixed, with some advocating for the potential benefits to consumers, while others raise concerns about the complexity of pricing structures, administrative burdens, and potential impacts on competitive negotiations. However, the executive order focuses squarely on directing federal agencies to utilize existing authorities to ensure the current rules are followed and strengthened, particularly concerning the accuracy and comparability of the disclosed price information and the effectiveness of enforcement mechanisms.
